These Terms & Conditions ("Terms") govern your access to and use of the FieldTrack Air™ platform, including its web portal, mobile applications, APIs, cloud services, artificial intelligence (AI) capabilities, analytics, and related software and services (collectively, the "Services").
FieldTrack Air™ is proprietary software owned by SharpGurus, Inc. ("SharpGurus," "we," "our," or "us"). SharpGurus Software Solutions India Private Limited is the authorized distributor, implementation, consulting, customization, training, and support partner for FieldTrack Air in India and other designated territories.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
1. Acceptance of Terms
By accessing, installing, registering for, or using FieldTrack Air, you agree to comply with these Terms & Conditions and all applicable laws and regulations.
If you do not agree with these Terms, you must immediately discontinue use of the Services.
2. Description of Services
FieldTrack Air is an enterprise cloud platform designed for agricultural, environmental, infrastructure, forestry, industrial, and government drone operations.
The platform may include:
- Agricultural drone mission planning
- Drone fleet management
- Pilot management
- AI-powered crop intelligence
- Satellite imagery analytics
- Drone imagery analytics
- Soil monitoring
- Environmental monitoring
- Weather intelligence
- Spray planning and execution
- Fertilizer optimization
- Pest and disease monitoring
- Livestock monitoring
- Forestry monitoring
- Asset inspections
- Financial and operational dashboards
- GIS mapping
- Mobile applications
- APIs and third-party integrations
- Reporting and analytics
SharpGurus reserves the right to add, modify, suspend, or discontinue Services at any time.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- Providing accurate registration information.
- Keeping your information current.
- Restricting unauthorized access to your account.
- Promptly notifying SharpGurus of any suspected unauthorized use.
You are responsible for all activities occurring under your account.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes.
- Violate aviation or environmental regulations.
- Upload malware or malicious software.
- Attempt unauthorized access.
- Reverse engineer, decompile, or disassemble the software.
- Circumvent security measures.
- Submit fraudulent or misleading information.
- Interfere with platform operations.
- Infringe the intellectual property rights of SharpGurus or others.
SharpGurus may suspend or terminate accounts that violate these Terms.
5. Drone Operations and Regulatory Compliance
FieldTrack Air assists in planning and managing drone operations but does not replace legal responsibilities.
Users are solely responsible for complying with all applicable:
- DGCA regulations (India)
- FAA regulations (United States)
- EASA regulations (where applicable)
- Civil aviation authority requirements
- Airspace restrictions
- Agricultural chemical regulations
- Environmental regulations
- Privacy laws
- Insurance requirements
- Local permits and licenses
Operation of drones remains the responsibility of the drone operator.
6. Artificial Intelligence and Decision Support
FieldTrack Air utilizes Artificial Intelligence (AI), Machine Learning (ML), satellite imagery, drone imagery, weather information, IoT devices, soil sensors, and analytical models to generate recommendations.
These recommendations may include:
- Crop health analysis
- Pest detection
- Disease prediction
- Fertilizer recommendations
- Irrigation recommendations
- Spray planning
- Yield estimation
- Operational analytics
- Financial insights
All recommendations are advisory only.
Users must independently verify recommendations before making operational, agricultural, environmental, financial, or safety-related decisions.
SharpGurus does not guarantee specific agricultural results, crop yields, financial performance, or operational outcomes.
7. Data Accuracy
FieldTrack Air may utilize data obtained from satellites, drones, sensors, weather providers, government agencies, and third-party systems.
Although reasonable efforts are made to ensure reliability, SharpGurus does not guarantee the accuracy, completeness, timeliness, availability, or suitability of such information.
Users should independently verify information before relying upon it.
8. Third-Party Services
The Services may integrate with third-party providers including:
- Drone manufacturers
- Mapping providers
- Weather services
- Payment gateways
- Government agencies
- Cloud providers
- Identity providers
- Mobile application stores
SharpGurus is not responsible for the availability, performance, accuracy, or policies of third-party services.
9. Intellectual Property
FieldTrack Air™, including all software, source code, object code, APIs, databases, artificial intelligence models, documentation, reports, workflows, graphics, trademarks, logos, designs, user interfaces, and related intellectual property, is owned exclusively by SharpGurus, Inc. or its licensors.
No ownership rights are transferred to users.
Users receive only a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.
SharpGurus Software Solutions India Private Limited is the authorized distributor, implementation, consulting, customization, training, and support organization for FieldTrack Air in India and other designated territories.
10. Subscription, Licensing and Payments
Where applicable:
- Subscription fees shall be paid according to the applicable Order Form or Agreement.
- Licenses are non-transferable.
- Fees are generally non-refundable unless required by applicable law.
- Failure to pay may result in suspension or termination of Services.
Enterprise agreements may supersede this section where expressly stated.
11. Privacy and Data Protection
Use of the Services is also governed by the applicable Privacy Policy.
Users consent to the collection, storage, processing, transmission, and analysis of operational data, telemetry, imagery, uploaded documents, geospatial information, and related information solely for providing, securing, improving, and supporting the Services in accordance with applicable laws.
12. Mobile Application Permissions
The FieldTrack Air mobile application may request access to the following device features and data to enable core functionality:
- Location (GPS): to record field boundaries, tag spray mission locations, track drone and pilot position during operations, and enable geospatial mapping and analytics.
- Camera: to capture field, crop, drone, and asset images for inspections, damage reports, KYC verification, and mission documentation.
- Photo Gallery / Media Storage: to select, upload, and store existing images and documents (such as land records, KYC documents, and inspection photos) required for platform workflows.
These permissions are used solely to provide, support, and improve the Services described in these Terms. Users may decline or later revoke these permissions through their device settings; however, doing so may limit or disable features that depend on location, camera, or media access, such as mission tracking, field tagging, and document/photo uploads.
Location, camera, and media data collected through the mobile application are handled in accordance with Section 11 (Privacy and Data Protection) and the applicable Privacy Policy.
13. Availability
SharpGurus strives to maintain high service availability but does not guarantee uninterrupted access.
Service interruptions may occur due to maintenance, cloud infrastructure issues, internet failures, force majeure events, cyber incidents, or third-party outages.
14. Limitation of Liability
To the maximum extent permitted by law, SharpGurus shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages, including loss of profits, crop losses, business interruption, loss of goodwill, or loss of data.
SharpGurus' total aggregate liability shall not exceed the subscription fees paid by the customer during the twelve (12) months preceding the event giving rise to the claim.
15. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
SharpGurus disclaims all express, implied, statutory, and other warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, reliability, security, and accuracy.
No oral or written advice shall create any warranty unless expressly provided in a written agreement signed by SharpGurus.
16. Suspension and Termination
SharpGurus may suspend or terminate access to the Services if:
- These Terms are violated.
- Applicable fees remain unpaid.
- Fraudulent or unlawful activities are detected.
- Continued access presents a security or legal risk.
Users may discontinue use of the Services at any time, subject to contractual obligations.
17. Changes to These Terms
SharpGurus may modify these Terms from time to time.
Updated Terms become effective upon publication on the FieldTrack Air website or application.
Continued use of the Services constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by the laws of India.
Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India, unless otherwise provided in a separately executed enterprise agreement.
Where a customer contracts directly with SharpGurus, Inc., the governing law and jurisdiction specified in the applicable Master Services Agreement (MSA), Subscription Agreement, or Order Form shall prevail.
